General Questions About Firearms Law

As leading and recognized experts in the field of firearms law, Michel & Associates receives numerous calls each day from individuals and businesses with general questions relating to California and federal firearm law.

Firearms law is a unique and challenging specialty. Firearm laws are complex, particularly in California. There are thousands of state statutes regulating firearm manufacture, distribution, sale, and possession. There are thousands more cases interpreting these statutes. That does not include the countless regulations, local laws and ordinances, agency regulations and policies, treatises and articles. And there are complex and comprehensive overlapping federal laws and regulations that must also be considered. There is great confusion about what these laws require.

People often turn to Michel & Associates, P.C. for help understanding their rights and responsibilities. These questions typically address the general requirements of firearms regulations and whether those laws apply in a particular situation, the process for obtaining a permit to carry a concealed firearm, the procedure for getting back a firearm that has been seized, and the possibility of restoring one’s right to own a firearm.

Our firearms law attorneys are former prosecutors, trial lawyers, constitutional law professors, and authors of best-selling firearms law books and articles. Together, our team is unparalleled in firearms law and firearms-related litigation and advocacy. Our clients include the NRA, law enforcement agencies and officers, industry trade associations, gun shows, importers, manufacturers, distributors, retail firearm dealers, FFLGuard, indoor and outdoor shooting ranges, prop houses, armories, pyro-technicians, and individuals who face firearms-related federal or state licensing and compliance issues or criminal charges.

If you are the subject of a pending criminal investigation or charges, or if you have a pending civil legal matter or other criminal or civil dispute which requires immediate legal services, we are happy to continue to provide prompt, free initial case consultations. Simply call (562) 216-4444 or email us at for an appointment.

Unfortunately, because of the time it takes us to process the large number of inquiries we receive, we are generally no longer able to answer general questions about firearms law without charging for our services. We wish this weren’t necessary, but this policy is necessitated by increased staffing costs, as well as the demands of our larger clients to prioritize and aggressively pursue ongoing and planned litigation challenging the numerous anti-gun-owner and anti-self defense statutes, ordinances, and policies being passed or enforced throughout the state. We trust those with questions recognize that we are an independent law firm and that we must cover our costs.

To help those with questions free of charge, we have produced several summaries of the law for guidance, as well as a list of answers to frequently asked questions. Prior to incurring costs for our legal services to answer a question, you should consult these free sources of information by following the steps laid out below. If these resources don’t answer your question, we have created an economical system for arranging a consultation with one of our attorneys. This is addressed in Step 3 below.

Step One: Buy the Book!

To answer the vast majority of the questions that we are asked, Michel & Associates’ senior attorney, C.D. Michel, has written a book on firearms law entitled “California Gun Laws: A Guide to State and Federal Firearm Regulations.” More information about the book and its contents is available at

This book should be your starting point in seeking answers to questions about firearms law.  The book contains answers to many of the frequently asked questions our office receives about firearms law. We strongly suggest you purchase Mr. Michel’s book as a starting point to understanding California firearms laws.

Step Two: Check the Website.

If the book doesn’t answer your specific question(s), please visit: for additional in-depth discussions of California and federal firearm laws that supplement the materials in the book. is a pro bono effort produced by the lawyers at Michel & Associates. It is designed primarily for use by attorneys, interested firearm owners, and Second Amendment civil rights activists. supplements the book California Gun Laws: A Guide to State and Federal Firearm Regulations. provides easy access to the multitude of complex federal, state, and local firearm laws and ordinances, administrative and executive regulations, case law, and past and current litigation that defines the California firearms regulatory scheme in theory and practice. is designed and organized to make it easy to research the law and to locate source materials and related information. The site also has links to the frequently asked questions sections of the California Department of Justice Bureau of Firearms, ATF and other helpful websites such as NSSF and NRA-ILA.

In addition to compiling and publishing firearms law related information and providing on-line legal research tools to access that information, also seeks to keep its users informed and aware of their legal rights and responsibilities, and active in efforts to reform and improve the law.

Step Three: Consult with Our Attorneys

If you’re in a hurry and you need an answer directly from a representative right away, we charge $400 for up to 60 minute consultation with a lawyer.

We discount that fee by $100 for NRA members or for CRPA members, and another $100 if you own the book. You can join NRA for $40.00 here. You can join CRPA for $35 here. You can buy the book here.

So for NRA and CRPA members who have the book, we only charge $200 to speak to a lawyer. And just so folks don’t think we’re taking advantage, we donate these consultation fees towards the pro-Second Amendment work we’re doing in California.

Please submit your question by email at or through our Case Evaluation Request form. Please remember this though, California’s gun laws are very complicated, with lots of “grey areas.” Unfortunately, there isn’t always a straight answer to every question about California’s gun laws.
