6/15/2016 Court ORDER granting #166 Motion for Extension of Time to Complete Discovery: The Court grants Plaintiff’s request to reopen discovery for the limited purpose of obtaining business records from Asian World of Martial Arts, Inc. The Court sees no reason why the described settlement negotiations cannot conclude before the 6/20/16 deadline. Accordingly, both parties are directed to file the JPTO by 6/20/16. 9/22/2015 Court ORDER denying #158 Motion for Leave to File: The Court denies Plaintiffs ex parte motion to file certain documents and objects with the Court in advance of his deposition and trial in this action. Local Civil Rule 39.1(a) states, Unless the Court orders otherwise, trial and hearing exhibits shall not be filed with the Clerk, but shall be retained in the custody of the respective attorneys who produced them in court. Mr. Maloney seeks to deposit the items in question with the Court in advance of his deposition to assure their availability for trial. However, no trial date has been set, and the items in question have not been offered as exhibits at any Court hearing. Therefore, they do not qualify as trial or hearing exhibits. In any case, Local 39.1(a) requires the attorneys to keep custody of trial and hearing exhibits. Mr. Maloney has not provided a compelling reason for the Court to take custody of the items in question. Upon Plaintiff’s consent, and because the Court finds that Plaintiff has an obligation to advise Defendant that he may be withholding documents based on his invocation of a Fifth Amendment privilege, Plaintiff’s 9/13/15 letter is hereby unsealed. 9/21/2015 Court Minute Entry for proceedings held before Judge Pamela K. Chen: Telephone Conference held on 9/21/2015. Appearance by telephone by James Maloney for Plaintiff and Liora Ben-Sorek for Defendant. The Court ruled that Plaintiff’s witnesses, Chris Pellitteri and Kevin Orcutt, must be offered as expert witnesses pursuant to FRCP 26(a). Plaintiff must therefore comply with the procedures associated with expert witness disclosures and reports, and Defendant may challenge these witnesses’ qualifications to testify as experts. The Court also noted that it may merge any Daubert hearing into the bench trial to streamline the proceedings. Ordered by Judge Pamela K. Chen.
