CRPA’s Magazine Ban Challenge Moves to Scotus

The fight for your Second Amendment rights has reached a critical moment. On behalf of our client the California Rifle & Pistol Association (CRPA.org), we filed a petition for certiorari with the U.S. Supreme Court (SCOTUS) in Duncan v. Bonta case. This case challenges California’s unconstitutional ban on standard-capacity magazines. CRPA is asking SCOTUS to finally weigh in to end certain biased courts’ defiance of the clear precedent set by SCOTUS in the Bruen case.

This isn’t just about magazine bans—it’s about the proper application of the Second Amendment’s protections in courts nationwide. For too long, jurisdictions have imposed absurd restrictions, ignoring the fundamental right to keep and bear arms, and some courts have bent over backwards to uphold them. By taking the Duncan case, the Supreme Court can emphatically reaffirm and strengthen the constitutional standard for Second Amendment cases so that every court in the country must apply it faithfully. It’s an action that is long overdue.

This case has all the characteristics to become a true landmark SCOTUS decision, standing alongside the landmark Heller and Bruen decisions. The case was tried twice, and a full record was developed each time. So, there is a complete record and a judgment on appeal. The case checks all of the boxes that SCOTUS looks for when deciding to take a case.

Over the coming months, the Justices will meet weekly to decide which cases to accept. If four Justices agree, Duncan will move forward—and the future of Second Amendment jurisprudence will be forever changed.
