The U.S. Department of Justice and a coalition of 26 states have filed amicus briefs in support of the challenge to California’s ammunition background check law in Rhode v. Bonta.
The federal Department of Justice submitted an amicus brief backing the plaintiffs, emphasizing the constitutional defects in California’s ammunition purchasing scheme. In addition, attorneys general from 26 states joined together to file a separate amicus brief, further underscoring the national significance of the case and the widespread concern over California’s restrictions on lawful firearm ownership.
“This extraordinary level of support—from both the federal government and more than half the states in the country—demonstrates just how extreme California’s ammunition laws are,” said Chuck Michel, of Michel & Associates P.C. “The State cannot point to any historical tradition that would justify Proposition 63. The Founders clearly understood that ammunition is a necessary component of the right to keep and bear arms.”
Rhode v. Bonta is currently pending en banc review before the Ninth Circuit Court of Appeals, marking the latest chapter in a legal battle that has stretched nearly a decade since the passage of Proposition 63. That measure imposed a sweeping regulatory regime on ammunition purchases, requiring background checks for every transaction and creating unconstitutional barriers to the exercise of Second Amendment rights.
In July, a three-judge panel of the Ninth Circuit agreed, holding that California’s ammunition background check law violated the Constitution. The State subsequently petitioned for en banc review, which is now scheduled for argument on March 23, 2026.
The decision by the federal DOJ to weigh in on this case significantly strengthens the challenge to California’s unlawful ammunition restrictions. MAPC is grateful for this powerful support and deeply appreciative of the members and supporters whose continued contributions make this fight possible.
