Michel & Associates Amicus Brief in United States v. Hemani Challenges Federal Marijuana-Related Gun Ban

Michel & Associates, P.C. (MAPC) has assisted the Second Amendment Law Center (2ALC), California Rifle & Pistol Association (CRPA), the Second Amendment Foundation (SAF) and allied groups in filing an amicus brief with the U.S. Supreme Court in United States v. Hemani, a case challenging the federal government’s lifetime ban on firearm possession for marijuana users.

“The historic number of Second Amendment cases pending before the Supreme Court covers the ‘who, what, and where’ of gun rights,” said MAPC Founding Partner Chuck Michel. “Hemani is the central case about ‘who,’ and it is essential that the government be held to the highest scrutiny, as the framers intended, when it strips an individual of fundamental rights.”

The policy at issue affects millions of otherwise law-abiding Americans who risk losing their Second Amendment rights solely for using marijuana—now legal in 40 states, including California, where it is widely accepted for both medical and recreational use.

MAPC seeks constitutional clarity on this issue and urges the Court to affirm the Fifth Circuit’s ruling, which recognized the lack of historical basis for such a broad and permanent prohibition.
