1/17/2017 | Court | MINUTE ORDER: The Court held a Status Conference in this matter on January 12, 2017 at which Plaintiffs requested a stay of all proceedings pending resolution of their interlocutory appeal to the United States Court of Appeals for the District of Columbia Circuit (“D.C. Circuit”) of this Court’s March 7, 2016 #54 Memorandum Opinion and Order denying Plaintiffs’ #6 Motion for Preliminary Injunction. Defendants oppose the request and seek to proceed to the filing of cross-motions for summary judgment. Previously, the Court denied Plaintiffs’ #59 Motion to Stay Proceedings, finding that a period of discovery was appropriate to develop a sufficient evidentiary record in this matter (see #63 Memorandum Opinion and Order, at 45). However, now that the discovery period has concluded and the necessary records will be on hand, the Court finds it prudent to stay this matter until the Court receives a mandate from the D.C. Circuit, which will obviate the parties’ need to potentially rebrief or supplement their motions for summary judgment in light of the D.C. Circuit’s ruling. Accordingly, the Court hereby ORDERS that all proceedings in this matter shall be STAYED until the D.C. Circuit issues its mandate. Signed by Judge Colleen Kollar-Kotelly on 1/17/2017. |

2/12/2016 | Court | Minute Entry for proceedings held before Judge Colleen Kollar-Kotelly: Telephone Conference held on 2/12/2016. (Court Reporter Lisa Foradori.) |
2/12/2016 | Court | MINUTE ORDER: The Court held a conference call on the record today with the parties. The Court raised the issue of consolidating preliminary injunction briefing with briefing on the merits. Plaintiffs support consolidation. Defendants object to doing so, stating that a full record is necessary for consideration of the merits and rely on Heller v. District of Columbia (“Heller II”), 670 F.3d 1244 (D.C. Cir. 2011), in support of that proposition. The Court, therefore, will proceed to consider the motion for a preliminary injunction prior to any briefing on the merits. With respect to further briefing on the preliminary injunction, Plaintiffs have indicated that they would rely on their initial brief in support of their motion for preliminary injunction. Defendants will supplement the arguments in their previously filed opposition to the motion for preliminary injunction by filing a replacement brief no later than FEBRUARY 18, 2016. Plaintiffs shall file a reply, which replaces their original reply, no later than FEBRUARY 25, 2016. Finally, the Court welcomes amicus briefs in this case. Amici in support of Defendants shall file any briefs no later than FEBRUARY 18, 2016, and amici in support of Plaintiffs shall file any briefs no later than FEBRUARY 25, 2016. Signed by Judge Colleen Kollar-Kotelly on 2/12/2016. |

2/11/2016 | Court | MINUTE ORDER (paperless). A telephone conference call, on the record, is scheduled for 1:30 p.m. on February 12, 2016. The parties have indicated their availability at that time. Signed by Judge Colleen Kollar-Kotelly on 2/11/2016. (lcckk2) |
2/11/2016 | Court | MINUTE ORDER (paperless). Notices of related case have been filed by the Plaintiffs and Defendants in this case indicating that this case is related to Grace v. DC (15-cv-2234), which is pending before Judge Richard J. Leon. The Defendants in Grace filed a notice of related case in that case as well. Plaintiffs in the Grace case filed an objection to this case being considered a related case, which they noted as well when they originally filed that case. The Court notes that this case is the lower numbered case, and this case would be considered the primary case if the cases were deemed related. See LCvR 40.5(c)(2) (“Where the existence of related cases in this Court is revealed after the cases are assigned, the judge having the later-numbered case may transfer that case to the Calendar and Case Management Committee for reassignment to the judge having the earlier case.”). Signed by Judge Colleen Kollar-Kotelly on 2/11/2016. (lcckk2) Modified on 2/12/2016 to correct typographical error in citation (lcckk2). |

2/9/2016 | Court | Set/Reset Deadlines: Joint Status Report due by 2/12/2016. |
2/9/2016 | Court | MINUTE ORDER (paperless). This case has been reassigned in light of the decision of the D.C. Circuit Court of Appeals, which vacated the preliminary injunction previously issued by Judge Frederick J. Scullin, Jr., in this case. In light of the reassignment, Defendants’ #33 Motion for Case Reassignment and Plaintiffs’ #34 Motion to Extend Time to Respond to Defendants’ Motion for Case Reassignment are DENIED AS MOOT. The Court will provide the parties an opportunity to provide additional briefing on the motion for preliminary injunction. Accordingly, the parties shall file a Joint Status Report by no later than FRIDAY, FEBRUARY 12, 2016, at NOON, indicating whether they intend to file supplemental briefing. If they do, they shall include a proposed schedule for expedited briefing in light of the time constraints for resolving a motion for a preliminary injunction under local civil rule 65.1. As a final matter, the Court notes this case pertains to a different statute than the one that was at issue in Judge Scullin’s decision in Palmer v. DC (09-cv-1482).
